nytimes: Data Transfer Pact Between U.S. and Europe Is Ruled Invalid

Europe’s highest court ruled on Tuesday that a widely used international agreement for moving people’s digital data between the European Union and the United States was invalid. The decision, by the European Court of Justice, throws into doubt how global technology giants like Facebook and Google can collect, manage and analyze online information from their millions of users in the 28-member bloc. Die Richtlinieüber die Verarbeitung personenbezogener Daten bestimmt, dass die Übermittlung solcher Dateninein Drittland grundsätzlichnur dann zulässig ist,wenn das betreffende Drittlandein angemessenes Schutzniveau dieser Daten gewährleistet. Ferner kann nach der Richtlinie die Kommission feststellen, dass ein Drittland aufgrund seiner innerstaatlichen Rechtsvorschriftenoder internationaler Verpflichtungenein angemessenes Schutzniveau gewährleistet. Schließlichsieht die Richtlinievor,dass jeder Mitgliedstaateine oder mehrere öffentliche Stellen benennt, die in seinemHoheitsgebietmit der Überwachung der Anwendungder zur Umsetzung der Richtlinieerlassenennationalen Vorschriften beauftragt sind („Datenschutzbehörden“).
